Terms of Service
These Terms of Service (the Terms) set out the basis on which South Wellness Group Pty Ltd provides health and wellness services to clients across Melbourne VIC and greater Victoria. Please read them carefully before requesting a quote, making a booking or using our website.
1. About these Terms
These Terms form a binding agreement between you and South Wellness Group Pty Ltd (ABN 44 702 744 698) (“South Wellness Group”, “we”, “us” or “our”). They apply when you visit our website at https://southwellnessgroup.online, request a quote, make a booking, or use any services we provide. By using our website or engaging our services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.
2. Who we are
South Wellness Group Pty Ltd is an Australian proprietary company providing health and wellness services to individuals, families and organisations. Our principal place of business is in Melbourne VIC, Australia, and our Australian Business Number is ABN 44 702 744 698.
3. Our services
We provide a range of health and wellness services, which may include wellbeing consultations, workplace wellness programs, lifestyle coaching and related support services, as described on our Services page. The exact scope of services, inclusions and deliverables for any particular engagement will be set out in your quote, booking confirmation or service agreement.
We may add, change or withdraw particular services from time to time. Information published on our website is general in nature, is provided for information purposes only, and does not form part of any contract between us unless it is expressly incorporated into a written agreement.
4. Health and wellbeing notice
Our services are designed to support general health and wellbeing. They are not medical treatment and do not constitute medical advice, diagnosis or therapy. You should not delay seeking, or disregard, professional medical advice because of anything provided through our services.
Before participating in any program or session, you must tell us about any relevant medical conditions, injuries, allergies, medications or pregnancy, and speak with your general practitioner if you are unsure whether an activity is suitable for you. You must follow all reasonable safety instructions given by our team.
If you feel unwell, dizzy or in pain during any activity, stop immediately and notify your practitioner. If you experience a medical emergency, contact emergency services immediately.
5. Eligibility
You must be at least 18 years of age to request a quote or make a booking with us. We may provide services to participants under 18 years of age where a parent or guardian provides consent and, where required, attends the booking.
By engaging us, you confirm that the information you provide about yourself, including health information, is accurate and complete, and that you are not aware of any condition that would make participation unsafe, other than any condition you have disclosed to us.
6. Bookings and appointments
Requests for services can be made through our Get a Quote page or by emailing ceo@southwellnessgroup.online. A booking is confirmed once we have issued a written confirmation (typically by email) and, where applicable, received payment or a deposit.
Session times are allocated on a first-in basis. Please arrive on time for your appointment, as late arrivals may result in a shortened session so that later appointments are not affected.
7. Cancellations, rescheduling and refunds
You may cancel or reschedule a booking by contacting us by email. We ask for at least 24 hours’ notice. Cancellations made with less than 24 hours’ notice, or failure to attend a booked session, may attract a cancellation fee as set out in your quote or booking confirmation.
If we need to cancel or reschedule a session for any reason, we will offer you alternative times or, where no suitable alternative is available, a refund or credit for the affected session. Refunds are processed to the original payment method within a reasonable time.
Nothing in this section affects your rights under the Australian Consumer Law.
8. Fees and payment
All fees are quoted in Australian dollars (AUD) and, where applicable, include GST. The fees applicable to a particular engagement are set out in your quote or service agreement.
Unless otherwise agreed in writing, invoices are payable within 7 days of issue. We may suspend the delivery of services or decline further bookings while amounts remain overdue. We may update our standard pricing from time to time; the price that applies to your engagement is the price confirmed in your quote or booking confirmation.
9. Your responsibilities
When using our website and services, you agree to:
- provide accurate, complete and up-to-date information, including relevant health information;
- follow reasonable instructions and safety directions given by our team;
- treat our staff, practitioners and other clients with courtesy and respect;
- not use our website or services for any unlawful purpose or in a way that infringes the rights of others;
- not reproduce, resell or distribute our program materials without our prior written consent.
10. Consumer guarantees under Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies that apply under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
11. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or in connection with these Terms or the services is limited, at our option, to resupplying the relevant services or paying the cost of having the services resupplied.
We are not liable for indirect or consequential loss, including loss of profits or opportunity, except where such a limitation is prohibited by law. Nothing in these Terms limits or excludes liability for death or personal injury, or any other liability that cannot be limited or excluded under the Australian Consumer Law or any other applicable law.
12. Privacy and your information
We collect and handle personal and health information in accordance with our Privacy Policy and the Australian Privacy Principles. Health information you share with us is treated as sensitive information and is used only to provide our services, unless you consent otherwise or disclosure is required or authorised by law.
13. Intellectual property
All content on our website, including text, graphics, logos and program materials, is owned by or licensed to South Wellness Group Pty Ltd and is protected by Australian and international copyright law. You may access and print materials from our website for your personal, non-commercial use. You must not reproduce, adapt, distribute or commercially exploit our content without our prior written consent.
14. Third-party content and providers
Our website may contain links to third-party websites. Those links are provided for convenience only, and we do not endorse and are not responsible for the content, products or services available on those websites.
From time to time we may engage independent practitioners or partner providers to deliver parts of a program. Where we do so, we remain responsible for coordinating your engagement, and these Terms continue to apply to the services we deliver to you.
15. Suspension and termination
We may suspend or terminate your access to the website, or cancel a booking, if you breach these Terms, provide false information, or behave in a way that endangers the safety or wellbeing of our team or other clients. You may stop using our website at any time.
Any provisions of these Terms which by their nature should survive termination (including the consumer guarantees, liability and intellectual property provisions) survive termination.
16. Complaints and feedback
We welcome feedback and take complaints seriously. If you have a complaint about our services, email ceo@southwellnessgroup.online with the subject line “Complaint”. We will acknowledge your complaint within 2 business days and aim to resolve it within 10 business days, or keep you informed if more time is needed.
You may also contact Consumer Affairs Victoria or the Australian Competition and Consumer Commission for information about your consumer rights.
17. Changes to these Terms
We may update these Terms from time to time by publishing a revised version on this page. The version published on this page at the time you request or receive services will apply to that engagement, unless you and we agree otherwise in writing.
18. Governing law
These Terms are governed by the laws applicable in the State of Victoria, Australia, and you and we submit to the exclusive jurisdiction of the courts and tribunals of Victoria.
